Agreement to Terms
By accessing or using Hoptock ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Hoptock is operated by Measurebit ("we", "our", or "us").
Description of Service
Hoptock is a desktop time tracking application that automatically monitors your computer activity and integrates with ClickUp to sync time entries. The Service includes:
- Desktop application for Windows, macOS, and Linux
- Activity tracking and time logging
- ClickUp integration for time entry synchronization
- Web-based account management
Account Registration
To use Hoptock, you must create an account with a valid email address. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must be at least 16 years old to use the Service.
Subscription and Payments
Free Trial
New users receive a 14-day free trial with full access to all features. No credit card is required to start the trial.
Paid Subscriptions
After the trial period, continued use requires a paid subscription. We offer monthly and annual billing options. Prices are listed on our website and may change with notice.
Billing
Subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method automatically at each billing cycle.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Reverse engineer, decompile, or disassemble the software
- Share your account credentials with others
- Use the Service to track others without their consent
- Resell or redistribute the Service without authorization
Intellectual Property
The Service, including its original content, features, and functionality, is owned by Measurebit and protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any data you create or upload to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service.
Third-Party Integrations
The Service integrates with third-party services like ClickUp. Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for third-party services or their availability.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Accuracy or reliability of any information
- Compatibility with third-party services
Limitation of Liability
To the maximum extent permitted by law, Measurebit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any unauthorized access to your data
- Any interruption or cessation of the Service
- Any bugs, viruses, or similar issues
Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Measurebit and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time by contacting support or using the account deletion feature.
Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
